How to Report Prison Misconduct in New York
For a New York State prison (DOCCS), there are two main ways to report staff misconduct. They serve different purposes, and in most serious cases you should use both.
1. OSI Complaint
The DOCCS Office of Special Investigations (OSI) independently investigates serious staff misconduct — excessive force, sexual abuse (PREA), and other criminal or serious wrongdoing by correctional staff.

- • Investigated by an office outside the facility
- • Can be filed by the incarcerated person, family, or an advocate
2. DOCCS Grievance
The Incarcerated Grievance Program (IGRC) is the facility's formal complaint process. Filing a grievance creates an official record and is often a required step before you can pursue a lawsuit.
- • Best for policy violations and day-to-day conditions
- • Creates a formal, dated record at the facility
- • Preserves your right to appeal and to sue later
